Crimes against privacy, the right to one’s own image and the inviolability of the home

  • CRIME OF DISCOVERY AND DISCLOSURE OF SECRETS (arts. 197 to 201 PC): Different conducts of apprehension and interception of communications of those who lack consent and intend to discover secrets or violate the privacy of another person are punished.
  • CRIME OF “SEXTING” (art. 197.7 PC): This specific modality punishes whoever, without the authorization of the affected person and even having received them from the affected person, disseminates, discloses or transfers to third parties images or recordings that undermine the personal privacy of such person.
  • CRIME OF BURGLARY OF DWELLING (arts. 202 and 203 PC): Punishes the action of entering or remaining in the dwelling (place where one lives, domicile) of a physical or juridical person against his or her will.
